These Terms of Service ("Terms") govern your access to and use of the website nightmaretv.net and the Nightmare TV desktop application ("Service", "Software"). By accessing the website, downloading the Software, or purchasing a license, you agree to these Terms.
1. Who We Are
Nightmare TV is operated by Tevfik Çapar, an individual developer based in Türkiye ("we", "us"). Payments are handled by Lemon Squeezy, LLC (Delaware, USA), acting as our Merchant of Record.

2. Eligibility
You must be at least 18 years old, or of legal age of majority in your jurisdiction, to purchase a license. By purchasing, you represent that the payment method you use is lawfully yours.
3. Software License
Use of the Software itself is governed by the separate End User License Agreement (EULA), which is incorporated into these Terms by reference.
4. Purchases and Pricing
- Prices are displayed in US Dollars (USD) on the purchase page. Local currency equivalents shown at checkout are provided by Lemon Squeezy and may include applicable taxes.
- All transactions are processed by Lemon Squeezy. Their Terms of Service apply to the transaction.
- We reserve the right to change prices of future purchases. Existing licenses are not affected.
- A Lifetime license covers future updates of the Nightmare TV 1.x line. Major-version upgrades (e.g. 2.0) may be offered at a discounted price.
5. Refunds
Refund terms are detailed on the Refund Policy page. Summary: 14 days, no questions asked, for first-time purchases.
6. Acceptable Use
You agree not to use the Service or Software to:
- Violate any applicable law, regulation, or third-party right (including copyright and broadcasting rights);
- Access, redistribute, or rebroadcast content for which you do not hold a valid licence from the rights-holder;
- Reverse-engineer, decompile, or extract source code from the Software beyond what applicable law expressly permits;
- Circumvent the license-key or device-limit mechanisms;
- Resell, sublicense, or redistribute the Software or your license key;
- Attack, overload, or probe our infrastructure, including license.nightmaretv.net.
We may suspend or revoke a license that is used in breach of these Terms without refund.
7. Content Disclaimer
The Software plays audio-video streams provided by your IPTV provider or media you own. We do not operate, index, endorse, or monitor any such streams. Any copyright, licensing, or regulatory issues arising from the content you choose to play are your sole responsibility.
8. Availability and Changes
We provide the Service on a reasonable-effort basis but do not guarantee uptime, uninterrupted availability, or that the Software will be free of bugs. We may modify, suspend, or discontinue features with reasonable notice. Security patches may be released without prior notice.
9. Intellectual Property
The Nightmare TV name, logo, website design, and the Software's source code are the property of Tevfik Çapar and are protected by copyright and trademark law. Nightmare TV bundles or links against third-party open-source components (including libmpv, FFmpeg, Flutter framework, and others) under their respective licenses. A full list and their license texts are included in the Software under About → Open Source Licenses.
10. Disclaimer of Warranties
THE SERVICE AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU USE THEM AT YOUR OWN RISK.
11. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service or Software shall not exceed the amount you paid for your license in the twelve (12) months preceding the claim. We shall not be liable for indirect, incidental, consequential, punitive, or special damages, loss of data, loss of revenue, or loss of profits.
12. Indemnification
You agree to indemnify and hold harmless Tevfik Çapar from any claim arising out of (a) your use of the Software in violation of these Terms, (b) your violation of any law or third-party right, or (c) the content you access through the Software.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. Disputes shall be resolved exclusively by the courts of Malatya, Türkiye, without prejudice to mandatory consumer-protection rules that apply in your country of residence.
14. Changes to These Terms
We may revise these Terms at any time. Material changes will be announced on the website. Your continued use after a change indicates acceptance of the revised Terms.
15. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the EULA, Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.
