This End User License Agreement ("EULA") is a legal agreement between you ("Licensee", "you") and Tevfik Çapar ("Licensor", "we") governing your use of the Nightmare TV desktop software ("Software"). By installing, copying or otherwise using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
1. Grant of License
Subject to your compliance with this EULA and payment of the applicable fee, we grant you a non-exclusive, non-transferable, revocable licence to install and use the Software on up to the number of personal devices permitted by your plan:
- Monthly, Yearly and Lifetime plans: 2 concurrent devices per license key.
A "device" is a single Windows or Android TV installation identified by a Nightmare-generated device ID.
2. License Types
- Monthly: subscription billed monthly by Lemon Squeezy. Access ends if payment fails or you cancel. The license key is revoked after a reasonable grace period.
- Yearly: subscription billed annually. Same rules as Monthly.
- Lifetime: one-time payment. Entitles you to use the current major version and receive updates and minor-version upgrades indefinitely, subject to Section 8 (Term & Termination). Major-version upgrades (e.g. 2.0) may require a separate upgrade fee.
3. Permitted Use
You may:
- Install and use the Software for personal, non-commercial entertainment purposes;
- Make one backup copy of the installer for archival purposes;
- Configure the Software with streams, credentials and EPG data that you lawfully own or are authorised to use.
4. Restrictions
You may NOT:
- Redistribute, sell, sublicense, lease, rent, lend or transfer the Software or any license key;
- Reverse-engineer, decompile, disassemble or attempt to derive source code from the Software, except and only to the extent permitted by mandatory applicable law (for interoperability purposes);
- Remove, alter or obscure any copyright, trademark or other proprietary notices;
- Bypass, disable or circumvent the license verification, device-limit or any security mechanism of the Software;
- Use the Software to infringe any third-party right, including copyright, broadcasting rights or applicable law;
- Use the Software on more devices than your licence permits, or share your license key with others.
A breach of this Section automatically terminates your licence without refund.
5. Ownership
The Software is licensed, not sold. Tevfik Çapar retains all right, title and interest in and to the Software, including all intellectual-property rights. No rights are granted to you other than those expressly stated in this EULA.
6. Third-Party Components
The Software includes or links against third-party open-source components, each governed by its own licence, including but not limited to:
- libmpv (LGPL-2.1 or later) — media playback engine
- FFmpeg (LGPL/GPL) — audio/video codecs and recording
- Flutter (BSD-3-Clause) — application framework
- SQLite (Public Domain) — local database
- Various Dart / Flutter packages under MIT, BSD and Apache-2.0 licences
The full list of components and their licence texts is accessible from the Software under About → Open Source Licenses and is incorporated by reference. In case of any conflict between this EULA and a third-party component licence with respect to that component, the component's licence controls.
7. Updates
The Software may check for and download updates automatically. Updates may contain new features, bug fixes or security patches and become part of the Software, subject to this EULA unless a new agreement is presented at update time.
8. Term and Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically if:
- You breach any term of this EULA;
- Your subscription (Monthly or Yearly) ends or is cancelled;
- You request deletion of your licence record.
Upon termination you must stop using and uninstall the Software. We may remotely revoke a license key that is used in violation of this EULA. Sections 4, 5, 9, 10, 11 and 13 survive termination.
9. Disclaimer of Warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.
THE LICENSOR DOES NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT, STREAM OR THIRD-PARTY SERVICE PLAYED THROUGH THE SOFTWARE. YOU ARE SOLELY RESPONSIBLE FOR THE STREAMS YOU CHOOSE TO PLAY.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR EXEMPLARY DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE LICENSOR'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY; IN SUCH JURISDICTIONS THESE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Export Compliance
You may not use or export the Software in violation of any applicable law, including export-control laws of the United States, the European Union or Türkiye.
12. Content Responsibility
The Software is a media player. It does not index, host, promote, encourage or provide access to any specific content. The Licensor is not a party to, and bears no responsibility for, any stream you configure the Software to play. Playing content without the right to do so may be illegal in your jurisdiction and is solely your responsibility.
13. Governing Law
This EULA is governed by the laws of the Republic of Türkiye. Disputes shall be resolved exclusively by the courts of Malatya, Türkiye, without prejudice to mandatory consumer-protection rules applicable in your country of residence.
14. Entire Agreement
This EULA, together with the Terms of Service, Privacy Policy and Refund Policy published at nightmaretv.net, constitutes the entire agreement between you and the Licensor regarding the Software and supersedes any prior agreement on that subject.
